The processing of personal data is governed in particular by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the “General Data Protection Regulation” or “GDPR”).

I. Processing of Personal Data

1. Processing of personal data when using email or other forms of communication

If you enquire about our products, we will process the contact details you provide to us, primarily through your order or by email communication. These include: first name, last name, billing and delivery details, email address, telephone number, and the selected goods you have decided to order from us.

Why do we process this data?

We use this information to contact you regarding your order and to arrange delivery of the goods to the contact details and address you have provided.

What is the legal basis for processing?

This processing is based on Article 6(1)(b) GDPR – performance of a contract or taking steps at your request prior to entering into a contract.

How long do we process your personal data?

If no further cooperation takes place, we will process your data only for the period necessary following our last communication. If no contract is concluded or you do not register as our customer, we will not continue processing your data.

2. Processing of personal data in the event of a purchase / registration

If you purchase from us or register with us, we will process the information you provide. This mainly includes billing details such as first name, last name, address, email address, and telephone number. For business customers, this may also include company name, Company ID, and VAT ID.

Why do we process this data?

We need to process your personal data in order to perform our contract with you, in particular to deliver the goods you have ordered. We will also use your contact details to communicate with you regarding the status of your order, any complaints, or your enquiries.

We also process personal data in order to comply with our legal obligations, in particular for accounting and tax purposes and, where applicable, for handling complaints and similar matters.

What is the legal basis for processing your personal data?

This processing is based on Article 6(1)(b) GDPR – performance of a contract, and Article 6(1)(c) GDPR – compliance with a legal obligation.

How long do we process your personal data?

For the duration of the contractual relationship and thereafter for a maximum period of 10 years from the last delivery of goods.

3. Newsletters (commercial communications)

If you give us your consent, we will process your email address and, where applicable, your name for the purpose of sending commercial communications relating to product offers, competitions, promotions, and news from our online store.

What is the legal basis for processing?

We process personal data for this purpose on the basis of your consent pursuant to Article 6(1)(a) GDPR.

How long will we process your personal data?

We will process your email address for newsletter purposes for the duration of your consent, but no longer than until such consent is withdrawn.

Consent to receive newsletters is voluntary and may be withdrawn at any time with effect for the future. An unsubscribe link is included at the end of every newsletter. If you unsubscribe, we will treat your consent as withdrawn and will continue to process the relevant personal data only to the extent necessary to demonstrate this fact, or we will delete it where no longer necessary.

You may withdraw your consent to receiving newsletters at any time with effect for the future. An unsubscribe link is included at the end of every newsletter. If you unsubscribe, we will treat your consent to receive marketing communications as withdrawn and we will delete the relevant personal data relating to user behaviour.

Retention period / criteria used to determine the retention period:

If you withdraw your consent to receiving newsletters from our enduro4all.cz online store, your email address will be removed from the relevant internal newsletter mailing database.

II. Who Has Access to the Data?

Your data remains with us. However, certain companies or individuals working with us may have access to your data because they help us, for example, with delivering goods to you. These include:

  • the operator of the Upgates e-shop platform, EVici webdesign s.r.o., Petra Bezruče 139, 747 91 Štítina, Czech Republic, Company ID: 28598661, VAT ID: CZ28598661
  • companies involved in shipping goods, PPL CZ s.r.o., K Borovému 99, Jažlovice, 251 01 Říčany, Company ID: 25194798

We process personal data only within the territory of the European Union.

III. Feedback on Completed Purchases

We want you to be satisfied, which is why your opinion about your purchase in our online store is important to us. For this reason, we use email questionnaires as part of the “Verified by Customers” programme to gather feedback on your shopping experience so that we can, where appropriate, improve the purchasing process and make it as convenient as possible.

Purposes of personal data processing / legal basis:

For the purpose of measuring your satisfaction with your purchase and the overall shopping process, we will process your email address, including information about your purchase in our online store, in order to send you a satisfaction questionnaire as part of the “Verified by Customers” programme, in the form of a commercial communication within the meaning of Section 7 of Act No. 480/2004 Coll. Completion of the questionnaire is voluntary.

In this case, the purpose of processing your data is our legitimate interest in understanding customer experience and satisfaction with purchases made in our online store, so that we can make any necessary improvements to our processes and ensure the highest possible level of customer satisfaction.

The legal basis for processing your data is therefore our legitimate interest as described above (Article 6(1)(f) GDPR), and this processing of personal data is therefore not dependent on your consent as the data subject.

You may object to the processing of your data, or to the sending of the evaluation questionnaire, before submitting your order. By ticking “disagree”, the questionnaire will not be sent to you.

Recipients / categories of recipients:

When processing personal data for the above purpose, we use a processor, namely the operator of the Heureka.cz portal. For the above purposes, we may provide it with information about your purchase in our online store and your email address.

Your personal data is not provided to any third party for its own purposes when email questionnaires are sent.

Retention period / criteria used to determine the retention period:

The period for which your email address is processed is connected to your registration in our online store, or it may be used on a one-off basis for this purpose.
